M2p and M2v files - why do they require transcoding?

i've made off air recordings using topfield pvr can transferred pc via usb , demuxed m2p or m2v. these demuixed files play out fine in windows media player.
adobe encore imports files no problem.
however in (not all) cases, insists files must transcoded, though plainly files aer dvd compliant. suspect might encore treats files have data breaks @ point (possibly because of weakness in transmission signal) non-compliant.
i'm told other dcvd authoring software less fussy encore in respect , honest it's real pain. encore expensive software , expect cope these files without having re-compress.
moreover, having upgraded 2.0 (i had 1.0.1 before) made dvd , there weird problems video (pal 720x576) "stuttering" backwards frame or so. not encoding problem because happened on 1 of files did not require trancsoding. has noticed on 2.0? never happened me on 1.01.

set top dvd recorders not recording files dvd compliant. prevent people recording movies or tv shows , making dvd them. why lot of time, such recordings able played on machine recorded them.
encore happily import files dvd compliant without re transcoding - having re transcode files on import means not dvd compliant.
retranscoding of files can happen if, example, source file mpeg audio , project set dolby digital audio.
